Company does not control User Content and is not responsible for any loss or damages arising from interactions with other users. Disputes between users must be resolved privately. You release and waive any claims against Company related to User Content.
If you are a California resident, you specifically waive California Civil Code Section 1542 with respect to these releases.
3. Disclaimers
The Site is provided “as-is” and “as-available.” Company and its suppliers disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Company does not guarantee the Site will be uninterrupted, error-free, secure, or free of viruses.
Where applicable law limits disclaimers, such limitations may not apply to you.
4. Limitation of Liability
To the maximum extent permitted by law, Company and its suppliers are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data. Your use of the Site is at your own risk.
Notwithstanding the above, Company’s total liability to you under these Terms will not exceed fifty U.S. dollars ($50), regardless of the number of claims.
5. Term and Termination
These Terms remain in effect while you use the Site. Company may suspend or terminate your access at any time for any reason, including violations of these Terms. Upon termination, your Account and rights to use the Site end immediately, and Company will not be liable for deletion of User Content. Sections 1, 2, 3, 4, and 6–10 survive termination.
6. Copyright Policy
Company respects intellectual property rights and will remove infringing content upon notice. To report copyright infringement, provide a written notice including:
- Your physical or electronic signature.
- Identification of the copyrighted work.
- Identification of the infringing material.
- Sufficient information to locate the material.
- Your address, phone number, and email.
- A statement of good faith belief that the use is unauthorized.
- A statement of accuracy under penalty of perjury.
False claims may result in liability under 17 U.S.C. § 512(f).
7. Changes to Terms
We may revise these Terms occasionally. Notice may be provided via email or posting on the Site. Changes become effective 30 days after notification. Continued use of the Site constitutes acceptance of the changes.
8. Dispute Resolution and Arbitration
Arbitration. All disputes arising from these Terms or the Site shall be resolved by binding arbitration on an individual basis. This does not prevent claims in small claims court or emergency equitable relief.
Rules. Arbitration will be administered by the American Arbitration Association (AAA). If the claim is under $10,000, non-appearance arbitration may occur via telephone, online, or written submissions. Arbitrator decisions are final and binding.
Waivers. You waive the right to jury trials and class actions. Arbitration proceedings are confidential. Claims of defamation, CFAA violations, and IP infringement are not subject to arbitration.
Jurisdiction. Where litigation is permitted, parties submit to the courts in Netherlands County, California.
9. Export Compliance
The Site may be subject to U.S. and international export laws. You agree not to export or re-export technical data or products in violation of such laws.
